ANA Terms of Use
The Applied Neuroscience Association (ANA) Terms of Use governs your access to and use of this website www.appliedneuroscienceassociation.com (the ‘site’) and in consideration of any other ANA services, content and systems, collectively referred hereto as ‘ANA’, ‘we’, ‘our’, ‘us’, and, ‘you’, ‘your’, ‘yourself’, ‘member’, ‘user’, meaning you as a consumer of ANA services, content and systems including this site and as a member of our Community.
By using the site, joining as a member of ANA, and/or using any other ANA services, content and systems, you are agreeing to be bound and abide by these Terms of Use, so, please read carefully before start. You further acknowledge, you have read and understood our Privacy Policy. If you do not agree to being bound by these Terms of Use or our Privacy Policy you should stop using the site and any other ANA services, content and systems immediately.
Users or members of the site and other ANA services, content or systems are at least 18-years of age and of legal age to be bound by these terms. If you are under 18-years of age, you are permitted to use the site with the express permission of your legal guardian. By using the site you represent and warrant that you meet these eligibility requirements.
This site contains services and content that is posted with the understanding that ANA is not engaged in rendering health services. On using the ANA site and any other ANA services, content and systems, no medical action should be taken or omitted in reliance of any information provided without seeking the advice of a physician or other qualified health professional. ANA disclaims all responsibility for any liability loss or risk, personal or otherwise, which is incurred as a consequence, directly and indirectly, of the use and application of any of the contents of this site.
ANA uses English language throughout this site and on any other ANA services, content and systems. In case of conflicts between the original English version and any translation, the English version shall prevail. Site contact and support is available during normal U.K. business hours by submitting a request to info@appliedneuroscienceassociation.com.
1. Definitions and Interpretation
In this agreement the following terms shall have the following meanings:
“Services” means collectively any online or offline services, content, functionality, facilities, tools, applications, products, or any other information that ANA makes available through the site or any other ANA channel either now or in the future;
“Content” means any text, graphics, images, audio, video, software, data compilations, and any other form of information capable of being stored in a computer that appears on or forms part of this site or is provided offline; and
“Systems” means any online or offline communications infrastructure that ANA makes available through the site or in-person either now or in the future. This includes, but is not limited to, web-based email, email links, message boards, live / group chat channels, ANA Events, the ANA Member Directory and ANA Member Network.
“Community” means any online or offline community of ANA members such as the ANA Member Directory and ANA Community Network that is bound and abides by the ANA CODE.
2. Intellectual Property, Copyright Infringement, Trademark Infringement
2.1 Respect the intellectual property, copyrights, patents and trademarks of others. Assuring adherence to current regulations and rules of law. This includes expression of ideas in your own words and giving credit where credit is due (non-plagiarism). Members content found in violation are not eligible for appeal and related content will be taken down. We respond to notices of violations or infringements or complaints, as described in our Feedback Policy.
2.2 By submitting content to ANA for uploading on the site or any other ANA services, content or systems, you are making a statement that in good faith you believe that use of the material in the manner it will be used is authorised for use by the copyright owner, its agent, or the law, or if original by you. You would be willing to make a statement under penalty of perjury that you have the copyright owner permission or are the copyright owner or the owner of an exclusive right to use, and that right is not being infringed.
2.2 All copyrights, trademarks, patents and content included on the site or any other ANA services, content and systems, unless uploaded by Members and Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software, articles, blogs, podcasts, is the property of ANA, our affiliates or other relevant third parties.
2.3 Material from the site may be re-used without written permission unless otherwise indicated on the site or content, or indicated where any of the exceptions are detailed in Chapter III of the Copyright Designs and Patents Act 1988 apply.
3. Disclaimer
3.1 No action should be taken or omitted by a User or Member in reliance of any information or advice placed on the site. The site is not intended to constitute advice, including medical advice and the Content of this site should not be relied upon when making any decisions or taking any action of any kind, including the application of personal protocols. This site contents is not intended for use to diagnose, treat, cure, or prevent any existing or future medical or psychological condition(s).
3.2 Whilst ANA uses reasonable endeavours to ensure that the site is secure and free of errors, viruses and other malware, all Members and Users are advised to take responsibility for their own security, that of their personal details and their computers. We would recommend that any downloaded information be virus-checked using reputable virus-checking software. ANA cannot accept any liability for damage sustained as a result of infection by computer viruses.
3.3 Unless otherwise specified, the materials on this site are directed at and are intended for use by those accessing the site from the United Kingdom. ANA makes no representation or warranty that any service, product, or information referred to or contained on this site are appropriate for use in other locations or jurisdictions. Those who choose to access this site from other locations or jurisdictions are responsible for compliance with any applicable local laws.
3.4 This site may contain links to other sites. Unless expressly stated, these sites are not under the control of ANA or that of our affiliates. As we have no control over the nature, content, and availability of those sites, we can assume no responsibility for such sites and disclaim liability for any and all forms of loss or damage arising out of the use of them. The inclusion of a link to another site on this site does not imply any endorsement of the site, any third-party affiliates, or of those in control of them or the views expressed within them.
4. Availability of the Site and Modifications
ANA site and any other services, content and systems are provided:
4.1 “As is” and on an “as available” basis. We give no warranty that the Services will be free of defects and / or faults. To the maximum extent permitted by the law, we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.
4.2 With no liability for any disruption or non-availability of the site or any other ANA services, content or systems resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.
4.3 With the right to alter, suspend or discontinue any part (or the whole of) and these Terms of Use shall continue to apply to any modified version of the site, services content and systems unless it is expressly stated otherwise.
5. Limitation of Liability
5.1 To the maximum extent permitted by law, ANA accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from site unavailability or the use of the site or any information contained therein.
5.2 Users should be aware that they use the site and any other ANA services, content and systems at their own risk and are responsible for their own health, and their own systems defence including virus checking.
5.3 These exclusions of liability shall not apply to any actions arising from death or personal injury resulting from any proven in a Court of Law negligence or fraud on the part of ANA or any of its employees or agents.
6. No Waiver
6.1 In the event that any party to these Terms of Use fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.
7. Communications
7.1 All notices / communications shall be sent by email to info@appliedneuroscienceassociation.com. If the notice is a legal notice, it will be deemed validly served if sent via an electronic system, by verifiable tracking documentation, such as a certified return receipt. If posted, it will be deemed validly received by a verifiable signature of receipt by the named recipient.
7.2 ANA may from time to time send you information about our services. If you do not wish to receive such information, please follow the unsubscribe process in any email you receive from us.
8. Payment Terms
8.1 ANA uses a third party Payment Service Provider of secure payment solutions PayPal (https://www.paypal.com/uk/business) to accept payments in connection with the ANA site and other ANA services, including with respect to membership subscriptions that involve currency exchange services in connection with payments made in local currencies. In most locations, payments can be made by using your PayPal Account or Debit/Credit card via the PayPal secure payment platform.
8.2 For online ANA payment services, you can review and accept the total amount requested to pay at each transaction. Service fees are added by PayPal at the time of purchase for use of the platform and foreign exchange services. These fees cover administrative costs that are charged to ANA and not to you.
8.3 You agree to receive invoices and or payment receipts from ANA via PayPal or online accounting software Quickfile in electronic form as PDF documents, by email, or through ANA, the site or PayPal site.
8.3. By making payments through the site, you accept and agree, on behalf of yourself or on behalf of your employer or any other entity (if applicable), to be bound and abide by the PayPal Commerce Platform terms found here. These terms protect against fraud, unauthorised transactions, claims or other liabilities in connection with payment information provided to PayPal for the purpose of processing payments as shown here. This information is subject to the privacy policy applicable to PayPal found here.
8.4 By using any payment method via ANA and/or providing your payment details for making purchases on the site, you represent and warrant that:
(a) you are authorised legally to provide such information;
(b) you have permission or are authorised legally to make payments using the payment method(s);
(c) if you are an employee or agent of a company or person that owns the payment method, you are authorised by that company or person to use the payment method to make payments on the site; and
(d) such actions do not violate any applicable law.
9. Violations of ANA Terms of Use
9.1 In the use of this site or any other ANA services, content or systems, or in provisioning services, content or systems for ANA, we will not tolerate:
hateful or harmful content or hate speech; harassment or bullying of any kind including hostility or discriminatory; threats of violence and incitement; spamming or nonsense; reselling or transferring ANA membership, use of derogatory language or graphic content; promotion of extreme or similar content or any content that is prohibited by any laws or regulations and or third parties terms of service; content that violates others privacy, reputation and personal safety; facilitating unethical services, deceptive conduct such as bribery, impersonating qualifications or plagiarism, compromising or collection of personal data, use of pseudoscience or misleading statistics, disinformation or any other content that is contrary to public health or safety.
9.2 Violations of ANA Terms of Use, may result in consequences such as restrictions from use/access, limited or restricted distribution of content, and ultimately suspension of membership. ANA has the sole authority and final decision as to whether content will be taken down and membership suspended.

13.1 In the event of any conflict between these Terms of Use and any prior versions thereof, the provisions of these Terms of Use shall prevail unless it is expressly stated otherwise.
13.2 These Terms of Use and the relationship between the User and ANA shall be governed by and construed in accordance with the Law of England & Wales and ANA and you agree to submit to the exclusive jurisdiction of the Courts of England & Wales.
