ANA Terms of Use

The Applied Neuroscience Association (ANA) Terms and Conditions of Use details the agreement between you (the User of this website) and the Applied Neuroscience Association or ANA (the owner of this website).  

Your agreement to comply with and be bound by these Terms of Use is deemed to occur upon your first use of the Website. If you do not agree to be bound by these Terms of Use, you should stop using the Website immediately. 

Upon joining ANA as a registered member, these Terms of Use should be read in conjunction with the ANA Code of Ethics and Professional Conduct (ANA CODE) and ANA Complaints Policy.

  1. Definitions and Interpretation 

1.1 In this agreement the following terms shall have the following meanings: 

“ANA” / “our” / “we” / “us” means Applied Neuroscience Association Limited;

“User” / “Users / “you” / “your” means any individual or third party that accesses and uses the Website Content, Services and Systems;

“Website” means the ANA website that you are currently using (www.appliedneuroscienceassociation.com) and any sub-domains of this site unless expressly excluded by their own Terms of Use;

“Content” means any text, graphics, images, audio, video, software, data compilations, and any other form of information capable of being stored in a computer that appears on or forms part of this Website;

“Services” means collectively any online facilities, tools, applications, products, or any other information or resources that ANA makes available through the Website either now or in the future; and

“System” means any online communications infrastructure that ANA makes available through the Website either now or in the future. This includes but is not limited to, message boards, live chat facilities, email links to ANA, and the ANA Directory.

2.1 In general, copyright, designs and patents require that the permission of the intellectual property MUST be sought before any use is made of it whatsoever. It should be noted that ANA logos and titles are the property of ANA and they, together with ANA registered address may only be used by permission.

2.2 All copyrights, trademarks, patents and content included on the Website, unless uploaded by Users who can prove ownership of the IP, including, but not limited to, text, graphics, infographics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of ANA, our affiliates or other relevant third parties. By continuing to use the Website you acknowledge that such material is protected by applicable United Kingdom and International intellectual property and other relevant laws. 

2.3 Material from the Website may be re-used without written permission unless otherwise indicated on the site or indicated where any of the exceptions detailed in Chapter III of the Copyright Designs and Patents Act 1988 apply.

6.1 ANA makes no warranty or representation that the Website or related content, services and systems will a) meet users requirements, b) be of satisfactory quality, c) be fit for a particular purpose, d) not infringe the rights of third parties, e) be compatible with all systems, f) be secure at all times, g) have information that will be accurate at all times in line with evolving neuroscience disciplines.

6.2 ANA makes no guarantee of any specific results from the use of our Services.

6.3 No part of this Website is intended to constitute advice, including medical advice and the Content, Services or Systems of ANA and this Website should not be relied upon when making any decisions or taking any action of any kind, including the application of any personal medical or otherwise protocols. 

6.4 ANA and ANA Website Content, Services and Systems is not intended for use to diagnose, treat, cure, or prevent any existing or future medical and/or psychological and/or other related condition(s). 

6.3 Whilst ANA uses reasonable endeavours to ensure that the Website, Content, Services and Systems is secure and free of errors, viruses and other malware, all Users are advised to take responsibility for their own security, that of their personal details and their computers. 

6.4 ANA does not hold any passwords on this Website.

7. Availability of the Website and Modifications 

7.1 ANA Website, Content, Services and Systems are provided “as is” and on an “as available” basis. We give no warranty that they will be free of defects and/or faults.

7.2 To the maximum extent permitted by the law, ANA provides no warranties (express or implied) of fitness for a particular purpose, accuracy of the information, compatibility and satisfactory quality. 

7.3 ANA accepts no liability for any disruption or non-availability of the ANA Website, Content, Services and Systems resulting from external causes including, but not limited to, cyber attack, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship. 

7.4 ANA reserves the right to alter, suspend or discontinue any part (or the whole of) the ANA Website, Content, Services and Systems, including, but not limited to, those currently available.

7.5 These Terms of Use shall continue to apply to any modified version of the ANA Website, Content, Services and Systems, unless it is expressly stated otherwise. 

8. Limitation of Liability 

8.1 To the maximum extent permitted by law, ANA accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of ANA Website, Content, Services and Systems unavailability.

8.2 Users should be aware that they use the ANA Website, Content, Services and Systems at their own risk.

8.3 Users are responsible for their own physical and mental health and wellbeing.

8.4 Users are responsible for the security of their own systems and anything related to their own systems, protecting them from viruses, malware, or related breaches. 

8.5 Every effort has been made to ensure that these Terms of Use adhere strictly to the relevant provisions of the Unfair Contract Terms Act 1977. However, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that specific term is to be deemed severed from these Terms of Use. This term shall apply only within jurisdictions of the Law of England & Wales where a particular term is denoted as illegal. This shall not affect the validity and enforceability of the remaining Terms of Use.

9. No Waiver 

9.1 In the event that any party to these Terms of Use fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy. 

10. Previous Terms of Use 

10.1 In the event of any conflict between these Terms of Use and any prior versions thereof, the provisions of these Terms of Use shall prevail unless it is expressly stated otherwise.

10.2 Nothing in these Terms of Use shall confer any rights upon any third party. The agreement created by these Terms of Use is between the User and ANA. 

11. Communications 

11.1 All notices/communications shall be sent by email to info@appliedneuroscienceassociation.com. If the notice is a legal notice, it will be deemed validly served if sent via an electronic system, by verifiable tracking documentation, such as a certified return receipt. If posted, it will be deemed validly received by a verifiable signature of receipt by the named recipient.
11.2 ANA may from time to time send you information about our services. If you do not wish to receive such information, please follow the unsubscribe process in any email you receive from us. 

12. Antiharassment 

12.2 ANA will not tolerate harassment of any kind, including discrimination or hostility or claims where jurisdiction is not proven.

13. Law and Jurisdiction 

13.1 These Terms of Use and the relationship between the User and ANA shall be governed by and construed in accordance with the Law of England & Wales and ANA and you agree to submit to the exclusive jurisdiction of the Courts of England & Wales.
